The contact owns a 2022 Mercedes-Benz S580. The contact stated while driving 70 MPH, the vehicle lost motive power. The contact was able to veer to the side of the road. The contact stated that the failure reoccurred several times while driving. The check engine warning light was illuminated. The vehicle was taken to the dealer, where the cam adjuster was replaced; however, the failure persisted. The vehicle was taken back to the dealer. The vehicle was not repaired. Additionally, the contact received notification of NHTSA Campaign Number: 23V445000 (Fuel System, Gasoline) however, the part to do the recall repair was not yet available. The manufacturer was notified of the failure and a case was opened; however, no further assistance was provided. The failure mileage was approximately 5,000.

The contact received notification of NHTSA Campaign Number: 23V445000 (Fuel System, Gasoline) however, the part to do the recall repair was not yet available. The contact stated that the manufacturer had exceeded a reasonable amount of time for the recall repair. The contact stated while driving at an undisclosed speed, the vehicle stalled and inadvertently lost motive power with the check engine warning light illuminated. The contact stated that the vehicle was towed to the dealer to be diagnosed; however, the vehicle was not repaired. The manufacturer was made aware of the failure. Consequence & remedy
Consequence: A brake fluid leak can extend the distance needed to stop the vehicle, increasing the risk of a crash.

Due to a software error in the hand detection control unit, the hands-off detection might not detect when the driver's hands are away from the steering wheel when using the Active Distance Assist DISTRONIC system.
Consequence & remedy
Consequence: Deactivated hands-off detection will prevent DISTRONIC system features from functioning, including warnings to grab the steering wheel and calling first responders as part of the Active Emergency Stop Assist, which can increase the risk of a crash or injury.
