The contact stated that upon depressing the accelerator pedal a second time, the vehicle jerked while responding sluggishly. The contact stated that the failure also occurred while making a turn. The contact stated that the accelerator pedal was depressed but the vehicle came to a complete stop, nearly causing oncoming traffic to crash into the vehicle. The contact stated upon depressing the accelerator pedal a second time, the vehicle jerked while responding sluggishly. The vehicle was taken to the dealer, where it was diagnosed and determined that the hybrid battery had failed and needed to be replaced. The vehicle was not repaired due to the cost. The manufacturer was not notified of the failure. The failure mileage was approximately 89,000.

This resulted in being hit by three cars. It looks like Lexus listed a notice, however we did not receive it, and were not aware of the notice. Waring lamps did come on please see pictures.

BRAKE BOOSTER NOT WORKING A SAFETY ISSUE TOYOTA WILL NOT TAKE RESPONSIBILITY THE SAME THING IS HAPPENING WITH THE PRIUS THEY USE THE SAME SYSTEM.
Toyota is recalling certain model year 2010 Prius vehicles manufactured March 31, 2009, through October 9, 2009; and model year 2010 Lexus HS250h vehicles manufactured June 19, 2009, through October 9, 2009. Nitrogen gas from a component of the brake booster pump assembly could leak into the brake fluid.
Consequence & remedy
Consequence: As nitrogen is released into the brake fluid, the brake pedal may have reduced hydraulic pressure. Under certain circumstances, this condition could affect stopping distance and increase the risk of a crash.
Remedy: Toyota will notify owners, and dealers will replace the affected brake booster pump assemblies. The recall began on August 7, 2013. Owners may contact Toyota at 1-800-331-4331.
TOYOTA IS RECALLING CERTAIN MODEL YEAR 2010 HS250h LEXUS VEHICLES FOR FAILING TO COMPLY WITH THE REQUIREMENTS OF FEDERAL MOTOR VEHICLE SAFETY STANDARD NO. 301, "FUEL SYSTEM INTEGRITY." WHEN THE VEHICLE WAS ROTATED FOLLOWING A CRASH TEST AS REQUIRED, THE AMOUNT OF FUEL LEAKAGE EXCEEDED THE ALLOWABLE LIMITS.
Consequence & remedy
Consequence: FUEL LEAKAGE, IN THE PRESENCE OF AN IGNITION SOURCE, COULD RESULT IN A FIRE.
Remedy: TOYOTA WILL NOTIFY OWNERS AND DEALERS WILL REPAIR THE AFFECTED VEHICLES BY INSTALLING A NEWLY DESIGNED PROTECTOR COMPONENT FOR THE FUEL FILLER INLET PIPE FREE OF CHARGE. THE SAFETY RECALL BEGAN ON AUGUST 9, 2010. OWNERS MAY CONTACT LEXUS AT 1-800-255-3987.

NHTSA received a petition on or about July 18, 2022, requesting that Federal Motor Vehicle Safety Standard (FMVSS) 141 be applied to all electric and hybrid vehicles operating in the United States. The petition can be reviewed at NHTSA.gov under ODI Number 11486072. FMVSS 141 establishes performance requirements for pedestrian alert sounds for motor vehicles. The standard applies to hybrid and electric vehicles that have a gross vehicle weight rating of 4,536 KG or less or are defined as low-speed vehicles. The standard became fully applicable to all such vehicles manufactured on or after March 1, 2021.On January 27, 2023, NHTSA opened Defect Petition (DP) 22-005 to evaluate the subject matter described in the petition. On June 24, 2023 and as supplemented on June 25, 2023, the petitioner notified NHTSA he was withdrawing his petition. The petitioner indicated that, based on his review of data, there is no justification for asserting potential benefits that could be derived from actions sought by my petition. Based on the petitioner's withdrawal, DP22-005 is closed. Closure of this DP does not represent a determination by NHTSA regarding the subject matter of the petition.
